Protest Procedure
The right to Protest lies solely with any competitor. Whom, may feel aggrieved by any decision, act or omission of an organizer, official or competitor. Protests against the decision of a "Judge of Fact", is not admissible. A collective Protest is inadmissible. A late, Protest is inadmissible, unless the Race Directors deem it was impossible to lodge a Protest at the time, within the time limits allowed.

Lodging a Protest.
The intention to Protest must be made in writing to the COC for the day. He will advise on the course of action to be taken. The Protest must be accompanied by the relevant Protest fee as defined. The written Protest , must be made on the Official MiniMoto SA Protest form, (see Appendix A)

Time limits for Protests.
  • A Protest against starting positions; within, 10 minutes of the notification of such positions.
  • A Protest against the decision of a Scrutineer or the Clerk of the Course; within 30 minutes of the notification of the decision. Whether technical or otherwise.
  • A Protest against Championship Points will be made within 5 days of the relevant event taking place.
  • A Protest against the course (Track) or distance of a race; 30 minutes prior to qualifying.
  • A Protest against any Technical irregularity; 15 minutes prior to the start of the first heat on the day, or, 15 minutes after the last heat.
Protest Fees;
  • Any non-technical Protest; the fee is R300-00. Non refundable. Any further costs to entertain the hearing will be for the account of the Protester.
  • Any Technical Protest; the fee is R1000,00. Plus any further costs, requiring experts to assess and report on the irregularity/ies. Should the Protested machine be proved to be in compliance with the rules, the Protestor, will cover any costs to restore the Protested parties machine to race condition.
(Protest fees maybe paid in the form of; cash, cheque or promissory note. All fees due, must be paid within 48 hours)

Findings of a Protest hearing.
The findings of any technical Protest shall be deemed final. No appeals are allowed. The findings of any non-technical Protest may be appealed. See below.

Appointment of Race Directors to handle Protests.
If no Directors are appointed for the day, the following procedure will apply. The Clerk of the Course will appoint three Race Directors to conduct the hearing. The appointed persons may not have any direct interest, in the class concerned, neither may they have any financial or conflict of interests, in the class concerned. Race Directors may impose further penalties as they deem fit. Or cancel penalties.

Appeals.
Appeals are only accepted for non technical decisions. An Appeal may only be accepted within 60 minutes of the decision of the Race Directors, at a Protest hearing. The Appeal cost is R1000.00. Non refundable. The findings of an Appeal hearing shall be final. The Appeal members may impose further penalties, or overturn penalties. The members of an Appeal hearing are appointed by the Clerk of the Course and the MiniMoto SA committee.

Protest and Appeal Fees.
All Protest and Appeal fees will be used to further the MiniMoto SA aims in any way they deem prudent.
